Solar panels on the neighbours' wall

Questioner

Question 1: We intend to install solar panels. Our terraced house is now located between 2 higher (one higher income) houses. The wish is therefore to attach solar panels to the outside wall of our neighbours in order to catch the sun. This outside wall is on our land. We have now tolerated this (new construction at the time and is described in the purchase contract with many things if I understand correctly) but then the question is whether I am allowed and able to hang something on it. The neighbours think this is fine by the way. Question 2: If this is set in stone, who will own the solar panels if the neighbors move or do not move? Question 3: What about liability for damage?

Lawyer

1) must be stated in the deed, otherwise the decisive question is whether this wall is also shared? 2) If point 1 has not been arranged, you will still need to arrange this because the solar panels will then be part of the neighbours' permanent wall. 3) You are liable if damage occurs due to the installation and possession of solar panels. If things are not yet clear, I will have to see the deed and check the other facts (shared wall yes/no). Please contact me via info@rechtinjestad.nl
