How do I hold someone liable?

Questioner

I made an appointment at my beauty salon on October 21st to have my eyebrows plucked/waxed. Then, without asking for permission whether I wanted it or not, the lady dyed my eyebrows. I have been terribly allergic to hair and eyebrow dye since 2007, and because of her actions my eyebrows were terribly burned. In June before that, I lost my job as a baker and I was just trying to make a fresh start as a truck driver. Because of the eyebrow incident, I was set back months, the poison had to leave my body, and after the eyebrows started to improve a bit, it went down to my groin, which started to look and feel just as burned as my eyebrows did then. In the meantime, I have been seeing a dermatologist for a few months, have already had a variety of medications, ointments, etc. and I am behind with my education. The UWV requires me to send a letter to Mrs. eyebrow, but I have no idea how or what to do, or what my rights are. I have saved all conversations with the lady and have photos of the injuries etc. Can you please help me? Kind regards.

I see two omissions, madam should have asked if you were allergic but given your history you should have stated that you were as a warning and certainly after you saw or noticed her working with the paint. The question is therefore whether you can hold her liable in this case.

I've been to her before, before corona started, but I haven't been there during corona, so she knew about it. I didn't realize she was working with dye, if you're as allergic as I am, you know better and have been doing everything to avoid it for years. If I ever want to know whether a dye works for me or not, it is tested on my arms days in advance. Plus I didn't ask for her to dye my eyebrows. When you go to the hairdresser, the hairdresser asks what you want, and what you say the hairdresser does anyway? When she put some on my eyebrows while I was lying flat in the chair, I didn't think about paint at all, because she's never done that to me before. I thought more about wax or a mask. Because paint wasn't even mentioned, I didn't realize it until the next day when my skin slowly started to burn, and it kept burning. Please help with this 🥺

Yes, I agree with you so far. You don't expect your eyebrows to be dyed if you didn't give that order. Could you really not notice anything during the treatment, not even a smell? You will be able to hold her liable for the damage because she did not take good care of her client. The question is how she has arranged the damage and liability in terms and conditions? Otherwise, feel free to contact me via info@rechtinjestad.nl? Perhaps I can help you draw up the liability claim.
