Undo bid?
Questioner
Good afternoon, Last Friday afternoon, March 18th, I made a bid on a travel deal. I did not realize that the bid was for 1 person. I thought the bid would be for 2 people. I only saw that later. I had made a bid of 250 euros and in the confirmation the total amount appeared to be 520 euros including booking costs. I immediately called travel deals and wanted to cancel for that reason, but then I have to pay 179 cancellation costs. It is too sad that this amount is so high and also cannot be undone by the short response time to cancel (within half an hour). Below I have copied the rules and conditions from the website reizendeals.nl. I have already let you know by email that I want to cancel. I have not transferred anything yet. 12. Cancellation In case of cancellations, Reizendeals applies the cancellation conditions. Cancellation is only possible by e-mail. Please note that a cancellation of a package holiday is never free of charge. Only if you have taken out cancellation insurance and for a valid reason, you are entitled to (partial) reimbursement of the travel sum, this can be requested from your own insurer. If you book a trip, we therefore advise you to take out cancellation insurance. Cancellation and termination fees: The right of withdrawal does not apply to package holidays. But it is possible at Reizendeals at the moment that you place the highest bid on a package trip to cancel your deal within 14 days. For this you owe €179,- termination costs to Reizendeals per purchased deal. For this, you must meet all the following conditions: - You wish to cancel the package holiday deal within 14 days of placing the highest bid and - You must notify us of the cancellation by email and - You must agree to the termination fee by email and - You haven't paid for the deal yet and - You have not yet reserved the deal via the booking form. If you do not meet the above conditions, it is no longer possible to cancel the deal against the €179 termination costs and you are obliged to pay the deal to Reizendeals. I would like to hear from you whether I can still get rid of the costs of 179,- Kind regards,Lawyer
Under consumer law, there are a number of obligations for the provider of such trips. For example, the question is whether it was sufficiently clear what the total price would be. Certain information must be provided before the agreement is concluded (Art. 7:502 BW). This includes, for example, the total price, the minimum number of persons, etc. This must be done clearly and in a conspicuous manner. In addition, the question is whether there is a justified termination compensation in the event of termination so soon after the agreement (7:509 BW). A number of regulations regarding bidding probably also play a role here. Without the exact content of the offer and the other conditions, it is difficult to give concrete advice.
