How much compensation can I claim?
Questioner
In April 2021 I bought a kitchen from XX in Almere. After delivery in July, this kitchen would be installed in two days by a technician arranged by XX. I paid €11,220 for delivery of the kitchen and €1,295 for the fitter. A lot went wrong with the delivery and installation. The service and communication with XX is far below standard. Promises were not kept and the mechanic failed to show up. The location manager of XX came to see me several times. He confirmed and understood my dissatisfaction. He promised to improve, but that did not happen. It is now a year later and the kitchen is still not finished. I have informed XX that this is unacceptable to me and that I expect generous compensation. The location manager let me know that he understood my view of the course of events. My question is: Can I claim damages (non-pecuniary damages) from XX and if so, what is a reasonable claim?Lawyer
I can imagine that you want a quick solution to this matter. It is not easy to say in advance how much compensation/amount you would be entitled to. For that it is important to know exactly what happened and what was said by both parties. For the price you paid, you are entitled to a properly functioning kitchen. If that is no longer possible, you are in principle entitled to compensation or repair. Does the company still plan to do anything about the situation?
