Assessment of Settlement Agreement

Questioner

I have received a settlement agreement from my (ex) employer. I have had an early WIA benefit since last year because I am 100% incapacitated for work. Now after 104 weeks of illness the VSO. Question: is this position of the employer correct?

Lawyer

You are not obliged to enter into a settlement agreement, but there may be a good reason for this, namely if you want to receive the transition payment (in addition to other payments such as those relating to any outstanding vacation days). However, I advise you not to sign anything before you have been advised by an employment lawyer. Please feel free to contact me without obligation. I specialize in this. See the profile page for my contact details.
