Can a landlord increase rent?

Questioner

My landlord wants to increase the rent. We did not agree on any increases in the contract. Does he have the right to increase it? What are my rights if I don't want him to increase the rent?

Lawyer

If there is no social housing and the rental agreement does not state anything about possible increases or indexation of the rent, the landlord cannot simply increase the rent. The landlord may always make proposals to increase the rent and you can agree or disagree with them. Without a rent increase clause or agreement between the parties, the landlord can only come up with a reasonable proposal to increase the rent. If you do not agree, the landlord can have the request assessed by the court. If the court finds that the request is reasonable and you still do not accept it, the landlord can request the court to terminate the lease. It is therefore wise to at least check whether this is a reasonable increase. Please feel free to contact me through my profile if you have any questions.
