Do I have to repay my studies after applying for dismissal?

Questioner

Started a training in November. My employer paid for this training. I have now resigned and my employer wants compensation. I am willing to pay compensation, but they want 2 thirds back and offset it with my salary. I have never seen or signed a study agreement. At the time she did say that I had to sign something, but that did not happen. Do I have to pay back or not and what compensation would be fair.

Lawyer

Based on case law, a study only needs to be repaid if a number of conditions are met. The employer may be expected to inform the employee in advance of the (financial) risks of the repayment. It must also be clear before the study begins how many costs must be repaid and how the reduction is. If no signature has been 'collected' it becomes difficult to determine whether the repayment obligation has been agreed to. Based on your stated facts, it is unlikely that you will have to pay back the costs. However, depending on all the circumstances of the case, it may be different. For that, I would need to know more about your situation. Please feel free to contact me via my profile if you have any questions or require legal assistance.
