Mandatory continued payment with on-call contract?

Questioner

Been working for 1.5 years now. I have always been able to work 4 to 5 days a week, mainly from 9 to 5. Now it is that the company has less turnover and can no longer offer the same hours. From now on, they can only offer me 1 or 2 days. Are they obliged to continue paying me (my salary is of course designed to receive the same amount every month) despite the on-call contract?

Lawyer

That chance is certainly there. An on-call contract may not continue indefinitely and at some point there is a legal presumption. That means that in principle the average number of hours of the past months must be considered. Ultimately it depends on the exact circumstances of the case. For example, has the employer complied with the legal requirements, etc.? You can contact me without obligation via my profile to discuss your case.
