Objection filed due to fine for mischief

Questioner

A while ago I received a fine of €250 for vandalism. I do not agree with this and that is why I filed an objection. Now I have to appear before the subdistrict court on June 7 to tell my story. If I understand correctly, I will also get a criminal record if I lose this case and I really do not want that at all. My question is whether it is wise to hire a lawyer?

Lawyer

Unfortunately, a penalty notice is also on the judicial documentation. In that respect, 'you already have a criminal record'. The judicial documentation also keeps track of open cases and cases that are not yet final. If you are acquitted in this case, the acquittal will be on your judicial documentation. At the subdistrict court, you may also be assisted by an authorized representative. This does not have to be a lawyer, but can also be a legal expert. In these types of cases, it is always wise to request access to the file in advance so that you can see exactly what has been reported by the police. You can request the file (or have it requested) from the Public Prosecution Service and/or the court. The file can be used to check whether the police followed the correct procedures and whether there is sufficient legal and convincing evidence to reach a conviction.
