Applying for a mortgage and getting married in Thailand
Questioner
I got married in Thailand in 2008 and have lived in Bangkok for the past 15 years. I returned to the Netherlands because of the corona problems while my wife and daughter still live in Thailand. Because of my permanent job in the Netherlands, we have decided that we want to live in the Netherlands as a family. Financially, my mortgage has been approved, but the bank wants my wife to sign an eviction deed. Both the bank and 2 notaries do not know whether my wife is allowed to sign this because it is not clear to them whether this is based on Dutch or Thai law because of my marriage. When I arrived in the Netherlands in 2020, according to the data in the Netherlands, I had no wife and daughter. Strange in itself because my daughter already had a Dutch passport. Only after providing the original marriage certificate and birth certificate were they registered as my wife and daughter.Lawyer
If you were married in 2008 in Thailand, then that is also valid in the Netherlands. However, data is not automatically linked, so you have to make an effort to also report your marriage in the Netherlands. However, I do not understand (either) the bank's requirement regarding an eviction certificate. I suggest that you contact the bank and/or a notary.Neem de volgende stap
