Can a gym restrict 24/7 access?
Questioner
I have a contract with a gym in my area. I have a contract for 24/7 fitness, and then I can work out unlimitedly. Now the following is happening: The gym owner is faced with the problem that members bring friends and let them in with their chip through the 24/7 revolving door. You can go in as often as you want. Now yesterday he set the revolving door so that you can only enter once a day with your chip. I myself regularly exercise twice a day, for example cardio in the morning and strength training in the evening. However, I can no longer enter twice a day because the gate is blocked. So now I can only enter a second time if the staff is present, and they are not always. I can also no longer get something out of my car if I have forgotten something, because then I can no longer get in. I pay for 24/7 unlimited, are they allowed to do this? What is the best thing to do? The owner is very hard to talk to..Lawyer
It is understandable that the owner is taking measures. However, now (as you also indicate) there are many more restrictions (also) for members who do not bring friends. In these situations it is always important to know what is in the contract. Suppose it would say that you are only allowed to exercise once a day, then it becomes a bit more difficult. But for the sake of convenience I will assume that with a 24/7 subscription you would exercise multiple times tomorrow. In that case, you are severely restricted by the owner's measure. This also happens in a way that goes further than necessary in relation to the interests of the owner. It seems to me that it should be technically possible to set the system so that you can only enter once per hour (or half an hour). This way, the interests of the owner are met and others can exercise more often. You can contact me without obligation via my profile to discuss matters further.Neem de volgende stap
