How can we recover costs for a private loan?

I (self-employed) and my partner (BV) both have a private (signed) loan with one and the same person, in question both approx. 3000,-. This person has not complied with the conditions and wants to get out of this. How can we recover our incurred costs?

What is important are the precise agreements you have made regarding the loan. If it has been agreed that the loan can be claimed in case of non-compliance with the conditions, this is possible in principle. The loan will then have to be repaid in full. What exactly you mean by 'costs incurred' is not clear to me.
