Report false accusations boss?
Questioner
2600 euros were taken from the work van and now I am accused of it and my colleague who has only been employed for 2 months and I have been employed for 11 years and who is allowed to continue working and I am being suspended and accused of having done it and I did not, my colleague took the money, counted it, put it in an envelope and sealed it and took it to the van and put it on the dashboard of the van to which I said don't put it there because then you will lose it. Put it in your trouser pocket and he said yes I know that too. And then put it in the dashboard and didn't keep it with him then we worked all day. When we arrived at the office at the end of the day I locked the van put the key in the warehouse and went home. The next morning I got the key again and opened the van with the central locking and it was already open. My boss arrived and asks for that money whereupon my colleague opens the dashboard to take it out and it is no longer there and so one of us must have taken it, because no one else knew that the money was there and I am 100% sure that I did not take it. My colleague must have done it but he denies it and says that he did not do it. Now I am being suspended and have been employed for 11 years and no money has ever disappeared from me in that time and my colleague who has been employed for 2 months is allowed to continue working and is not being suspended. During the investigation and report that my boss filed about the disappearance of the money that I had nothing to do with and therefore did not accept it from the customer, did not count it, did not put it in the envelope and did not put it in the mailbox and therefore did not touch it at all or anything and even warned him that he had to keep it with him and not put it in the mailbox, he ignored that and did it anyway, I am falsely accused of theft of the money and therefore want to file a report against my boss for false accusation (defamation and slander) in order to prove my innocence since he can never prove that I am guilty and thus wants to clear my name within the company, since my colleague continues to work during the investigation and is therefore not seen as a suspect and will apparently get away with it and I have to pay for it and I 100% did not do it and therefore do not want and cannot let that happen. Can I do anything about this legally?Lawyer
Yes, certainly. You could start summary proceedings in which you demand that the judge oblige your employer to let you work again. The employer will have to have good evidence for his claim that you did it and I assume that there is none. The suspension must also have a specific purpose. The employer often uses the time during which the employee is suspended to conduct research and consider possible employment law steps, such as summary dismissal. Of course, (very strict) requirements apply for this. I advise you to engage an employment law attorney as soon as possible. I am specialized. Feel free to call me for a no-obligation consultation. I also assist people on a pro bono basis (if they qualify). 06-30575754.Neem de volgende stap
