Notice period 1 year contract
Questioner
I have a 1-year contract. This expires on the last day of August 2022. On Thursday, July 28, I was informed verbally by my project manager that the contract will not be extended due to the company's changed future plans. I am a construction work planner and am working on a major transformation project. This project must be completed around the end of November 2022. Despite the fact that my contract will not be extended, I have been asked if I want to stay until the project is completed at the end of November. I have not yet received written notice of the non-extension of the contract. What is your advice?Lawyer
The employer is obliged to notify in writing at least one month before the expiry of the contract whether or not the contract will be extended. If the employer fails to do so, he is in principle liable for damages. What the employer actually wants to offer here is an extension for a shorter period than the previous contract and an employee is always free to accept this or not. If you want clarity, it is a good idea to address the employer about the lack of an actual written offer for the extension or not. You can also wait and see whether or not you can still report to work on 1 September. If you are allowed to return to work on 1 September and nothing has been recorded in writing, your contract will be extended again by 1 year, despite a verbal promise, under the same conditions as the current contract.
