Do I have to pay spousal support?
Questioner
My wife wants to divorce me because she wants other men in her life. She only wants to work a maximum of 3 days, she wants me to fill in the rest while she is healthy and can easily work 5 days, in addition, our adult (20 years old still in school) daughter will continue to live with me. I already bear these costs. She wants the divorce and to live on her own and that I continue to finance that. Should I continue to pay for her? Or should she work more (which is possible) and pay me because I am responsible for the care of our daughter?Lawyer
If your future ex only works 3 days a week and you work full-time, her unused earning capacity must be taken into account. This can be processed in the maintenance calculation to be made. If there is still a difference in ability to pay, spousal maintenance may still be an issue. This is only different if she starts living with a new partner. Child maintenance is no longer an issue between you and your future ex, because your daughter is of legal age. However, you must each contribute to your daughter's livelihood as long as she still goes to school or studies.Neem de volgende stap
