Do you work as a client without a temporary employment agency?
Questioner
I work for a recruitment agency. My annual contract expired at the end of August. In mid-July, I started working for a client via the recruitment agency. I have now received a new contract from my recruitment agency for the duration of the assignment I had already started. No indication was given of how long the assignment will last. I had to sign the new contract with employment conditions that were less good for me than the annual contract I had before. If I did not sign, I would not have a job as of 1 September, so I had to. I asked for a meeting a few times to negotiate the employment conditions, but the recruitment agency did not want that. They suggested that we only make an appointment for this in December. The contract contains an article stating that I am not allowed to work for a client for 12 months after my contract expires. Now I am satisfied with the assignment, but I no longer have confidence in the recruitment agency. I am now wondering to what extent there are possibilities to, for example, enter into employment with the client in order to no longer have to have contact with the secondment agency. Can you help me with this? Is the contract that I feel is forced legally valid? I feel stuck between a rock and a hard place.Lawyer
As I read it now, quite a lot did not go according to the right paths and your employer used the position of power to retain you under less favorable conditions. I cannot give you specific advice about this now, but it may be good to talk about it further. You can contact me via boksjuristen.nl.Take the next step
