Does an objection to DUO entitle you to a payment extension?
Questioner
I have filed an objection with the Objections and Appeals department of DUO against a decision of the Accounts Receivable department of DUO in which I requested them to postpone payment of overdue instalments of student debt until my objection has been decided. The Accounts Receivable department of DUO responded that an objection does not entitle one to postponement of payment and I would like to know whether the response of DUO's accounts receivable department is legally correct or not.Lawyer
If an objection is lodged against a government decision, this does not suspend the effect of that decision. If the decision is annulled in an objection, it will of course no longer have effect. Of course, you can always request the government not to implement the decision against which an objection has been lodged for the time being, until the objection has been decided. The government can then (but does not have to) respond in a compliant manner. In certain cases, it may be useful to initiate summary proceedings after an objection has been lodged, in which the court is asked to suspend the decision against which an objection has been lodged. If the court agrees, the government may then not implement the decision in the meantime. For such summary proceedings to be successful, certain (preconditions) must be met. For example, you must have a demonstrable urgent interest. The threshold is generally high.Questioner
Thank you for your answer.Questioner
For such summary proceedings to be successful, certain (marginal) conditions must be met. For example, you must have a demonstrable urgent interest. The threshold is generally high. I don't quite understand this sentence: 'The threshold is generally high.' Can you explain it to me in other words? Thank you in advance.Take the next step
