Pay invoice for cancelled order?

Questioner

I requested solar panels and signed an agreement with COMPANY NAME for the installation of the panels, signed at the beginning of October. Installation was to take place at the end of 2022/beginning of 2023. At the beginning of November I was called for the installation of the panels on November 4. However, the company did not come then, indicating that they had not made an appointment with me about this. I then cancelled the order. Now they indicate that an invoice will follow for the cancellation. However, my agreement does not mention anything about cancellation, termination, dissolution. Am I obliged to pay this invoice?

Lawyer

Good morning, In order to answer the question, it is important to check what is stated in the offer/agreement, but also any general terms and conditions. Have you confronted the entrepreneur with your observation (that there is nothing about cancellation, etc. in the agreement) and if so, what was their response? If you need help in what you can do best, please feel free to contact us (06-49175526). Kind regards, Mr. Silvienne Leito FerLei Legal

Questioner

Hello Silvienne I signed the agreement digitally. In the signed agreement/confirmation that I subsequently received. nothing is mentioned about conditions, cancellation etc. This is stated on the website. The entrepreneur indicates that I also agreed to the general terms and conditions when signing; which state that there is a two-week reflection period, and that cancellation after these two weeks will result in a charge of 250 euros. They now also indicate that I must pay the invoice of 250 euros based on this digital signature. Is this correct? Or can I still appeal to the fact that nothing about this was mentioned in the confirmation?
