Do I have a fixed-term or indefinite-term rental contract?

Questioner

I have a rental dispute due to termination of the lease and it is important to know whether I have a fixed-term or indefinite-term contract. - I rent a room (non-independent home). - The contract entered into force on October 1, 2018. - It was for half a year and is tacitly extended for another half year. Is it true that the contract is only converted into a permanent contract after 5 years because I am renting a non-independent home? Or is it already an indefinite period? I find it unclear because there is no end date in the contract.

Lawyer

Good afternoon, The rules for a tenancy agreement for an indefinite period have indeed changed since 2016. For independent residential spaces, a term of 2 years applies, after which the agreement can end by operation of law if this has been agreed. For non-independent residential spaces, a term of 5 years applies. What strikes me is that you state that an end date is not in the agreement, while you indicate that the agreement was entered into for half a year. How exactly was this agreed? Please feel free to contact us without obligation for more information (tel. 0649175526) and engage a lawyer in the event of a (threatening) rental conflict.
