Finally a rental home
Questioner
My ex and I have been separated since 2017 and now I finally have (after approval of the paperwork) a rental home. Now it is the case that my ex has already made it clear that he does not want to pay alimony and does not want to buy me out because that costs him money. We own a house together that is in both our names. He wants to keep the house and therefore wants the house to remain in my name. However, I am very afraid that if he cannot or does not want to pay the mortgage, I will be liable. So I do not want to remain in my name. How can I ensure that I am no longer in my name for the house and mortgage if I have a rental house?Lawyer

There are a number of ways in which you can transfer the property from your name. One of the most common ways is through a notarial deed in which you transfer the property to your ex via a deed of transfer. It is important to consider obtaining a certificate of no objection from the mortgage lender before the deed is executed. This is to prevent you from becoming liable for the mortgage after the property has been transferred into your name. Another option is to enter into a sales agreement with your ex and sell the house to a third party. This will also require a notarial deed and a statement of no objection from the mortgage provider.Neem de volgende stap
