Want to terminate a temporary employment contract by operation of law?

Questioner

My annual contract in education expires on April 1 and my employer indicates that they are obliged to extend it due to my early pregnancy (announced last week). They propose to extend my contract until after my maternity leave. They then propose that I resign myself at the end of this period. With this I lose my right to unemployment benefits. If I do not comply with the request to resign, the organization indicates that they are obliged to offer a third employment contract, but they will terminate this employment contract with a negative reference in advance and then part ways. My questions: - is it possible to say goodbye to someone with a temporary contract that is expiring within education, even if this employee is pregnant? - is it possible for an employer to legally terminate a temporary employment contract within education? - Can an employer indicate in advance that you will receive a bad reference, without actually having a reason for this? Thank you in advance for your response.

A temporary employment contract may also be terminated during pregnancy. It does not have to continue. This is no different in education. If they want the employment contract to continue, they can choose to define the period exactly, for example for another 6 months instead of extending it for a year. This still allows it to be terminated by operation of law and the employee retains the right to unemployment benefits. Indicating a bad reference in advance is strange. Especially when good work has been done. It is especially not nice to use this as a means of pressure. If you have any questions, you can contact me.
