More money for the house 5 years after divorce

Questioner

My ex and I divorced about 5 years ago. Mortgage in my name, but due to the community of property marriage it also became her property. Household effects divided among themselves and a redemption sum (verbally) agreed upon. Now that I may want to sell the house, my ex has indicated that he still wants to go to the notary for an official transfer. She indicates that she wants to have the current value of the house determined and asks for recent information regarding the mortgage. Because no valuation was drawn up at the time, I based the calculation of the redemption amount to the notary on the WOZ value and the accrued capital of the savings mortgage at the time of registration of our divorce with the municipality. Based on this calculation, it appears that I gave her more than double what she was entitled to at the time. Because I agreed to her proposal at the time and this (with the information available now) also compensates for any surplus value, I do not wish to claim this overpayment. If I do not agree with the division of the current value of the house and mortgage, she will want to enforce this through the court. I would like to know whether she can once again claim the property because this division has not been recorded by a notary. Yours sincerely,

It is important to know what was agreed at the time. I recommend reading the divorce agreement carefully and perhaps approaching the lawyer in question for further explanation.
