I am no longer together with my husband. We have been arranging the divorce with the mediator since mid-2022. Mid-December I bought a house, the agreement was signed on January 23. According to the mediator, everything you buy after 23-1 is separated. Only after signing the agreement could I apply for a mortgage, which was approved. March 1st is the transfer of the house and now the notary says that my ex is also the owner of the house and therefore also has to sign, because the divorce has not yet been registered with the municipality. According to the mediator this is not the case, because after signing the covenant everything is separated. Initially, the notary also told me that they would make a waiver for my ex, but now that is not possible and he will become co-owner. The mediator says it may depend on how the law is interpreted, but I don't know who is right.
