Cancel car purchase?

Questioner

We bought a second-hand car from a garage in January, with a 3-month warranty. We have now been back to the garage several times with this car, because the car had a number of defects. Now something is wrong again and the car is leaking a lot of oil somewhere. Every 100 km we have to top up with 1 liter of oil. When we bought it, the garage owner indicated that the car used oil, approximately 1 liter per 1000 km. We agreed to this. Only now the story appears to be completely different. We indicated this to the garage. In the meantime, we have had so much trouble with the car in about 6 weeks that we want to cancel the purchase and would like our money back. What are our rights and obligations?

Lawyer

Good morning, I assume that you purchased the car as a consumer. In principle, the following applies: the product must meet the purpose for which you purchased it (to drive it on public roads) and the expectations that were created when purchasing it. Of course, you do not have to accept that the car leaks a lot of oil, certainly not so soon after purchasing it. It is relevant to know whether you have offered the car for repair again. You also indicate that there has been 'so much fuss' with the car. Have more defects been found? In principle, you can cancel the purchase, but the defects must be so serious that the purchase agreement cannot remain in effect. In addition, the seller must have been given the opportunity to remedy the defects. If you wish to discuss your case further, you can contact us, of course without obligation.
