Divorce and alimony
Questioner
My partner recently indicated that he wants to divorce because of another woman. We have three children together. Of which 2 are in school (8 and 12 years old) and 1 is 3 years old. He wants to determine the alimony himself and wants to supplement me, as it were, in addition to the allowances that I could now apply for. Isn't it the case that child support must be calculated according to a legally required percentage? In addition to any allowances? Is it possible to have this calculated in this way? Unfortunately, my own salary is not sufficient to hire a lawyer myself.Lawyer

Child support is calculated based on the financial needs of the child and the ability of the parents to pay. In the Netherlands, the TREMA standards and tables of the NIBUD are often used to calculate child support. The TREMA standards and tables provide guidelines for calculating child support based on the net income of the parents and the age of the child. The costs of living of the child are taken into account, such as the costs of food, clothing, shelter, education and recreation. The TREMA tables contain standard amounts for the cost of living of children in different age categories. These amounts are based on the NIBUD budget survey and are updated annually. The amounts include costs for housing, food, clothing, insurance and the like. The parents' ability to pay is then determined. The parents' net income and any special expenses are taken into account. Special expenses include high housing costs, medical expenses, debts or costs for visitation arrangements. The capacity to pay is calculated using a calculation program, such as the Alimony Calculator of the Alimony Standards Expert Group. This program takes into account the personal situation of the parents and can differ per case. Ultimately, the amount of child support is determined based on the calculated ability of the parents to pay and the cost of living of the child. This amount can be revised annually, for example if there are changes in the financial situation of one of the parents or the needs of the child.Neem de volgende stap
