Wages withheld due to driving damage?
Questioner
I am a delivery person. Now my employer has withheld €500 for damage caused by driving. I myself did not notice that I had driven damage. It appears to be paint damage. I probably drove past bushes, but I did not notice that. I did sign a contract in which that is stated about the € 500. It is almost half of my salary. I was not reckless and there was certainly no intent. What are my rights in this?Lawyer
Ir/Madam, The employer is usually liable if the employee has caused damage. The employee is liable if the damage was caused deliberately (intent) and if the employee is not careful enough or deliberately takes many risks (deliberately reckless action). If the employer holds the employee liable, the employer must demonstrate that the employee caused damage. If he cannot do this, the employee is not liable. If the employee is liable, the employer may deduct the damage from the salary, but he must take into account the exempt amount. If you have any questions, please feel free to contact me.
