Abrupt divorce by wife
Questioner
Saturday May 20th my wife left home and moved to her parents. The next correspondence was the following Tuesday. Here she said that she had a lawyer for the divorce and that I had to answer 2 questions. 1. Do I want to continue living in the house. 2. Whether I wanted the same lawyer as her. I responded on Thursday that I had read it and would get back to it. I had to respond before the end of Friday while I indicated that I needed more time to process it. This afternoon (Friday) I received an email about the items purchased during the wedding (we got married on September 26, 2022) with the question that I have to supplement/check this). I think this is going very fast and have some general questions about the rights and obligations regarding which goods are considered community of property? Is it wise to take my own lawyer and how can I ensure that peace is restored so that we can complete the divorce within a mentally/emotionally healthy time frame.Lawyer
Since your wife already has legal representation, I would strongly recommend that you also hire an attorney to represent your interests. An experienced attorney will be able to advise you on your rights, obligations, and possible strategies during the divorce process. Your attorney will assist you in filing the necessary legal documents, negotiating the division of property and possibly alimony, and ensuring a fair settlement. Regarding your question about the community of property, in the Netherlands the statutory regulation of the community of property applies if no prenuptial agreement has been drawn up. The community of property generally includes all assets and debts acquired during the marriage. This includes real estate, bank accounts, vehicles, investments, furniture, jewelry and other valuables. However, there are exceptions to this rule, such as inheritances or gifts that have been obtained under a so-called exclusion clause. It is important to note that every situation is unique and the specific circumstances of your divorce may affect the division of community property. Your attorney will work with you to assess your financial situation and guide you in determining a fair division of community property.
