Buying a caravan with hidden defects?
Questioner
In May 2023 we bought a caravan from a private individual. We were not told at the time that the caravan had moisture damage. We asked about this and were told that there was no moisture damage. The seller did show various damages. But he did not report the major moisture damage and we could not see it because the awning was in front of it. When we called the seller later, he did indicate that it was already there but that they had forgotten to report it. Caravan brought to a dealer for servicing and they indicated that the damage could amount to 4000 euros. We paid 7900 euros for it ourselves. What are our rights and obligations and what are those of the seller?Lawyer
Good morning, It is unfortunate that the purchase is not in accordance with your wishes. It is important to record all agreements in writing, especially in the case of a purchase agreement between private individuals. If you have the seller's statement in writing that he was aware of this but forgot to report it, this could be grounds for cancelling the purchase on the grounds of error. You can also agree with the seller that the repair costs will be at his expense, if you wish to maintain the purchase agreement. Of course, it is important to first review all correspondence back and forth. Feel free to contact us to discuss your case further. Gr, Mr. Mr. S. Leito FerLei Legal 06-49175526Take the next step
