Camper purchase scam?

Questioner

In March my boyfriend and I bought a camper. We agreed that this camper would be repaired so that it could pass the MOT. When we took the camper we got the MOT certificate with it, without any comments or remarks. Last week we took the camper to another garage for a major service. It turned out that there was a lot wrong with the camper, so much that it could not have passed the MOT at all. The repair costs amount to 3 to 5 thousand. We really feel like we have been taken for a ride. Either by the dealer, or by the mechanic who did the welding for the MOT, or by the person who did the 'MOT inspection'. There was some cheating somewhere, or they are all cheating together. We did take a test drive when we bought it. Also after the MOT inspection. The welding seemed to have been done properly then (but turned out to be putty with paint on it). What leg do we have to stand on? We are thinking of having the repairs done, but then of course all 'evidence' will be gone (except for photos of course).

Lawyer

Good afternoon, Annoying situation you are in as a result of the purchase. I assume a consumer purchase. In that case, you could rely on error based on your case description: you wanted to buy the camper and you agreed that repairs would be carried out before the camper was delivered to you. However, the repairs were not carried out or were not carried out correctly. You could also base a claim on attributable failure and claim the additional damage. Among other things, a statement from another garage owner is required to demonstrate what the damage is. You are wondering whether there has been fraud. In civil law terms, this is called 'fraud'. This is usually not very easy to prove, because you as the claimant must prove that information was deliberately withheld. The discovery of sealant and paint residues to conceal repairs could be an indication, but more information is very likely necessary. In order to better assess your legal position, all documents must first be reviewed. Think of e-mails, WhatsApp messages, etc. It depends on what the parties have (demonstrably) agreed upon to determine what exactly you are entitled to. Feel free to contact us without obligation to discuss your case further. Gr, Mr. Mr. S. Leito FerLei Legal 06-49175526
