Signature legally valid?
Questioner
For medical reasons, we live with two families in one house. My parents-in-law, my wife and I. Now we have to move again because of homesickness and so we bought a house. The kitchen and bathroom have to be replaced. My wife and I will also live partly in the attic and we want to have a kitchenette built there with a simple bathroom next to it. My wife and father-in-law cannot drive back and forth all the time for medical reasons, so my mother-in-law and I represent both families. (For the record: my father-in-law bought the house, all renovations are also paid for by him). We went to a kitchen/bathroom store and spent 1 1/2 days there to get everything arranged/designed. During our presence I told them on both days that I am not the man of the money but my father-in-law. The quote made was therefore put in the family name of the in-laws. My mother-in-law picked out everything she needed, and later I did. At the end of the process an amount was finally agreed upon. If we decided quickly we would get an extra discount, which brought it closer to the budget amount. By the way, the budget was €61500,- In the end we ended up at €62350,- which was still possible according to my father-in-law. Then we were allowed to sign the papers (my father-in-law was still at home). I in my name (I have a different family name than my in-laws) and my mother-in-law in her name. This happened last Saturday. When we got home we saw that it was not a quote but an order confirmation. This had not been communicated clearly. Now it is Tuesday, and my father-in-law still wants to cancel the order. We can't reach them by phone, so he does it by email. Now my question: my mother-in-law's signature is legally valid. But is mine too? My name is not mentioned on the quote/order confirmation, and my father-in-law did not give me permission to sign. He assumed that there would first be a quote that he could look at and after approval an order confirmation that could be signed. Could you tell me if I am right?Lawyer
