Want to claim back extra costs due to incorrect scooter repair?

Questioner

We brought the scooter with a starting problem to a company. Without our knowledge, they brought the scooter to another company after 3 weeks, when we heard this we of course said that we did not agree with that. Eventually the man where we originally brought it carried out the repair as said, but he caused so much damage to the scooter that it gives so many more problems, and he broke the electric starter among other things. Brought it to another to have this repaired because the first one could not do it, it was too difficult. When we arrived at the other mechanic, he opened the saddle to look for the cable, it turned out that there were all cut wires running, a new battery had not been installed as said but an older one and also incorrectly connected, battery protection cover lost, lighting incorrectly connected, and there are many more things. We have held him liable for the extra costs incurred, which amounted to more than €600 for his account. He did not respond to that, except I do not pay. Then we put him in default but also no response. How can we proceed now to get the extra costs back and a scooter that drives well?

Lawyer

Good morning, A first step is indeed a notice of default. If there is no response, another letter must be sent (the so-called default letter). If there is still no response, you can summon the person. This must be done in the correct manner, otherwise it may have consequences for the process. It is also important what the parties have agreed upon, whether you can demonstrate the (additional) damage, etc. If you need assistance in the procedure, please do not hesitate to contact us.
