Rights regarding child visitation?

Questioner

In 2014 I split up with the mother of my 3 children, there is a signed parenting plan with contact arrangements. It states that I have the children for 1 week during the summer holidays and then the contact arrangements are in effect again. My question is what is she entitled to regarding the summer holidays, she has had them for 3 weeks in a row in the last few years. She now lives in Belgium with her new partner. I would like to have my children away for 2 weeks straight in the summer.

A contact arrangement is designed to protect the interests of both parents and children after a divorce or separation. This contact arrangement is usually binding; this means that both parties must adhere to it. In your case, if the mother of your children is in breach of the contact arrangement by keeping them with her for longer than agreed during the summer holidays, you may be able to take steps to correct this. In principle, you have the right to see them for two consecutive weeks during the summer if this is in the best interests of the children and is reasonable, but this also depends on the exact content of your parenting plan. If you want to make changes to the visitation arrangement, the first step is to discuss this with the mother of your children. If you both agree to the change, you can have the parenting plan adjusted. However, if the mother of your children does not agree to the change, you may be able to go to court to request the desired change in the visitation arrangement. The judge will always look at the best interests of the children in his decision. If you want to follow this route, it is wise to seek legal advice from a lawyer or attorney. Please note: As the mother of your children lives in Belgium, this may cause complications due to the different legal systems. It is therefore extra important to seek legal advice when considering taking legal action.' ---------------- Please note!
