Collection agency threatening bankruptcy?

Questioner

In 2021 I hired a debt collection agency to collect a claim for me. After receiving and paying 2 invoices, no results have been achieved. Now they would submit the claim to the court. After that I never heard from them again. Now they sent an invoice on 11-10-2023. I stated that I only receive invoices, but no results. They never got in touch again. Now I get an email from a law firm that they want to see money but with interest and costs. The last claim has doubled. I told them that I wanted to see the court verdict first and that they had not sent me a reminder about this invoice. Now there is a threat of bankruptcy. Now I don't know what to do anymore.

However, it seems like a complex situation. Although I cannot offer you a definitive solution, I can give you some orienting insights. First of all, it is important to check your contract with the collection agency. Find out what terms are mentioned there regarding their compensation, reminders for payment, the procedure at the court and communication. Secondly, if there was indeed an agreement to bring the claim to court, then there must also be a judgment. You have the right to request this judgment as proof that the proceedings were held. Thirdly, a threat of bankruptcy is not something to be taken lightly. This is a serious measure that can only be taken if there is an unpaid debt that is due. If a debt claim is still disputed, a bankruptcy petition can be dismissed by the court. In addition, it is important to gather evidence of your correspondence with the collection agency and the law firm, including your requests to see the judgment and to be reminded of the invoice. This may be useful later. Last but not least, if the situation is unclear and you need legal advice, it may be useful to contact a lawyer or legal expert to discuss this further. These are serious matters that require immediate attention to prevent them from escalating. This general advice should not be taken as legal advice.
