Insurance company recovers damages claim from me before legal proceedings have taken place?
Questioner
A year ago I got into a car mentally confused and under the influence, stopped by the police and an officer fell and suffered minor physical injuries. Now there still has to be a lawsuit, in which it will hopefully also become clear to what extent I am held liable. In the meantime, the insurance company has contacted me and indicated that the damage to the officer in question will be recovered from me 1 on 1. They are not allowed to clarify anything substantively, so I do not know what for or for how much. Are they allowed to do this just like that? [I have indicated in principle that I do not agree because I do not know what it concerns and there has not yet been a lawsuit]Lawyer
An insurer may indeed attempt to recover damages from an individual, even without a lawsuit. However, there is no guarantee that they will be successful in this recovery action. It depends on several factors. First, if the insurer can prove that you are liable for the damage for which they have paid out, they can recover the costs from you. This can happen, for example, in a car accident where you were the cause. However, a situation can also be more complicated. For example, if the insurer believes that you caused the damage intentionally, they can try to recover the costs from you. In both cases, the insurer may attempt this. However, you have the right to oppose this recovery action. If you disagree with the insurer, you may want to consider seeking legal advice. A lawyer or attorney can help you understand your rights and advise you on your best options for taking action. Please note that this is not exhaustive legal advice. It is important that you consult a professional who has all the details of your specific situation.Neem de volgende stap
