Continue working after retirement at a different location?
Questioner
On March 30, 2024, I will reach the retirement age of 67. I work in the care for the disabled and of course I know that my contract from that time will end then. If it were not for the fact that the employer and the collective labor agreement indicate that the possibility of continuing to work after your retirement is possible because people in care cannot find staff. I have indicated that I would like to continue working in the way I am working now, which is a 50% contract at a location in Doetinchem. Now my manager says in the conversation that my contract is legally expiring and that he does not want to continue it based on the current situation. I would be allowed to work at other locations, but not at the location where I have been working for 18 years. He wants to divide the percentages that will be released with my retirement among my younger colleagues. This while my team indicates that they would like me to continue working on location. You can probably understand that my enthusiasm for continuing to work in this way decreases and that I then actually stop completely. My manager indicates that he is not allowed to continue the contract on the basis as it is now (according to the law).Lawyer
Your question is a bit unclear, because you haven't indicated what kind of work you do, under what circumstances you want to continue it, whether you are currently experiencing problems carrying out your work in Doetinchem, and so on. Nevertheless, in the Netherlands everyone is in principle allowed to work wherever he or she wants, provided that any required permits, diplomas or other regulations that specifically apply to the profession in question are met. In some cases, termination of your employment or contract may limit your right to work in a certain place. In addition, there may be specific regulations, for example in connection with safety, that prevent you from carrying out your work as desired. In most situations you should be free to work wherever you want, but to accurately answer your question I need some more information. These are general considerations and not conclusive legal advice. It may be wise to consult a lawyer or attorney to assess your specific rights in this situation.Neem de volgende stap
