Increase rent with all-in agreement?
Questioner
I am the owner of a student house where 5 ladies live. Now I want to increase the rent because that hasn't happened for years, but the students say I'm not allowed to do that. So my question is, can I increase the rent and if so, by how much? The house is located in Tilburg.Lawyer
Increasing rent can be complicated under Dutch law, as various rules and restrictions apply. Whether and by how much you can increase the rent of your student accommodation depends on various factors, such as the type of tenancy agreement and whether the accommodation falls in the social or private sector. If your tenancy agreement is an all-in rent, it is important to know that the Rent Assessment Committee often splits this into basic rent and service costs. The amount that remains after deduction of the maximum service costs is the basic rent. Based on this, the number of points of the home according to the Housing Valuation System is determined. This then results in the maximum reasonable rent. It is important that the basic rent (after recalculation) does not exceed the maximum reasonable rent. For social housing, annual increase percentages apply that are determined by the government. For private sector housing, these increase percentages do not apply and in principle you can increase the rent as agreed in the rental contract. However, if the rent does exceed the liberalisation limit due to the rent increase, the tenant may object to the increase. Based on this information, consider seeking legal advice from a lawyer or attorney to determine whether and by how much you could increase the rent of your student accommodation. This way, you can ensure that any proposed increase is in line with the applicable regulations and thus avoid ending up in a conflict with your tenants.' ---------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
