Claiming medical injury damages

Questioner

More than two years ago I started laser hair removal treatment because I had quite a lot of unwanted hair growth. Now, more than two years later, I notice that the intended result of this treatment is not in line with the expectations, even the opposite. There is a considerable amount of hair growth, which was not present before. I am aware that no assurance or guarantee can be given or has been given regarding the desired or intended result of the treatment. However, it is true that a certain expectation has been created. In my opinion, this expectation does not correspond with the result of the treatment as it is now. During the process I had several conversations about the progress of the treatment and what I can expect from the result. I have already discussed this in this conversations indicated that I had the idea that hair growth seemed to be stronger in certain places. come, but I was then told that this should not be possible. However, it is now the case that, more than two years later, significant hair growth has occurred in places where I had not previously experienced this hair growth. had (especially on my upper arms, shoulders and upper legs). I correlate this new hair growth with the progression of the treatment. I am quite disappointed with this new hair growth, in places where I had this before not had. It seems logical to me that this phenomenon is not an expected result of the treatment that you have offered. For this reason I asked the laser clinic in question to talk to me, and they have offered me a contribution towards the costs. For 3 treatments I would only pay the costs of the I would have to pay for the laser and I could get all treatments after that with a 50% discount. However, I still find it unfair that I have to pay for the resolution of damage that they did to me. Hence my question about what my rights are. I know very little about what I can and cannot demand from them. It really bothers me and I experience hindrance in my daily life living with this unpleasant outcome of this process, and there is a bitter aftertaste in me when I think about the trajectory, the treatment, and the whole process. I hope you can help me further. I hope I have informed you sufficiently. Yours sincerely,

Based on what you have said, you may be entitled to compensation for personal injury. In Dutch law, two things are considered: liability and causality. Liability concerns the question of who is responsible for the damage. In this case, if you have experienced increased hair growth as a result of the treatment, then the laser clinic could possibly be liable. However, keep in mind that the clinic can also claim that the standard of care has not been violated. As you yourself indicated, there is no guarantee of the desired result when undergoing laser treatment. The causal relationship is about whether the damage is a result of the treatment. It is therefore important to demonstrate that the extra hair growth is a direct result of the treatment. This may be difficult because hair growth can be influenced by many factors. It is important that you gather evidence of all conversations and appointments you have had with the clinic. This can help establish liability and causality. The clinic has offered to offer you a number of treatments at a discount. However, it is understandable that you may not find this sufficient. You may want to hire a personal injury lawyer to help you claim personal injury compensation. This compensation can consist of material damages (such as the cost of new treatments) and non-material damages (such as suffering and emotional distress). I recommend that you speak to a lawyer or legal advisor about this to understand what your rights are in this situation. I have read some of this and I am surprised at what the clinic offers you as compensation. If they offer something and it is not what they propose and you also suffer physical damage as a result, then there is a case of personal injury due to unlawful conduct and misrepresentation of facts. If you contact me through this platform or via: groenewegenjuristen@gmail.com I can provide you with free legal assistance. I would like to hear from you further. Greetings, Mr. Groenewegen. J.
