To which account should child support be paid?

Questioner

The National Bureau for the Collection of Parental Support has, at our request, made a recalculation and advised that I should pay a monthly amount of child support for my daughter (she has been living with my ex-partner, her father, for a number of months). Initially, the LBIO indicated that I should transfer the amount to my ex-partner's account, but when I indicated that we work with a joint child account, they indicated that I should deposit this amount into the child account because all costs (subscriptions, pocket money, clothing allowance, etc.) are paid from that. I deposited the amount into the child account and now my ex-partner has withdrawn this amount. He is of the opinion that I should transfer the support to him. Is this correct?

Lawyer

In principle, the parent who receives child support is free to decide how to use this money. Child support is intended to contribute to the costs of raising and caring for the child. This includes a wide range of costs, including housing, food, clothing, school fees, sports activities, and so on. As for the question of which account the maintenance should be paid into, there is no hard law that gives clear guidelines. This is often based on the agreements that the parents make between themselves. If you initially agreed that the child support would be deposited into the joint child account, and the LBIO approved this, then you have fulfilled your obligation by depositing the amount there. If your ex-partner wants to change the agreements, he cannot do so unilaterally. This must be done by mutual agreement. In case of disagreement on this issue, it may be wise to seek the help of a mediator or lawyer specialized in family law. They can assist you both in making new agreements or clarifying the existing arrangement.
