Can I have a fine put in my name?
Questioner
A while ago I borrowed someone's car and I was flashed by a speed camera for driving through a red light. The owner of this car received the fine in his name while I was driving. I was wondering if this fine can be put in my name because the owner is on probation to keep his driver's license after he was stopped for the following: art 8 section 2 ahf/ond a Road Traffic Act 1994/ art 9 section 2 Road Traffic Act 1994. He got his driver's license a while ago but is now still on probation until he has to appear in court. Because I don't want to cause him any problems, if this fine has any influence on the decision to keep his driver's license, I would like the fine to be put in my name if that is possible and if not what is the best I can do. I hope to have informed you sufficiently, I look forward to your response and thank you in advance.Lawyer
It is understandable that you want to take responsibility for the fine you received while driving someone else's car. In the Netherlands, in some cases it is possible to transfer a traffic fine to the actual driver. In general, the fine is sent to the registered holder of the vehicle, in this case the owner of the car. However, if this person proves that he or she was not the driver at the time of the violation, the Central Judicial Collection Agency (CJIB) can transfer the fine to the actual driver. This can be done by filing an objection with the CJIB. Please note that it is important to discuss the specific situation and possible consequences with a legal expert. Especially since the owner of the car is on probation for previous traffic violations. It is also important to note that the procedure for changing the name on the fine can be complicated in some cases and the final decision lies with the CJIB. In your case, it is highly recommended to seek professional legal assistance to avoid any complications. It is not recommended to take action without professional legal advice.
