Cancelling a holiday due to illness?
Questioner
We were supposed to go on holiday to South Africa on December 6th. Unfortunately my husband had a brain haemorrhage. So I was forced to cancel the trip. Now the problem is this: we once took out continuous cancellation travel insurance. But now it seems that there is a maximum amount that can be paid by the insurance, it is probably stated in the policy, I did not think about having to upgrade the insurance. I have traveled like this for years and have never done this. But I wonder whether the travel organization should not pay out the remainder of the travel sum. I once understood that in case of cancellation you get the rest of the travel sum back from the travel organization, also taking into account the (special) reason for the cancellation. I hope I have been clear enough and that you can give me some advice on this.Lawyer
I hope your husband's recovery is going well. Regarding your question, the procedure after cancelling a trip depends on the terms of the cancellation insurance and the general terms and conditions of the travel organisation. In general, the costs of a cancelled trip are reimbursed by the cancellation insurance up to the maximum amount set in the insurance contract. If this maximum amount is lower than the total cost of the trip, you will in principle have to pay the difference yourself. The travel organization is usually not obliged to refund the rest of the travel sum, unless the cancellation was caused by a mistake on their part or there is force majeure. Special reasons for cancellation, such as serious illness, are indeed often covered by the cancellation insurance. However, the exact amount of compensation depends on the specific terms of your insurance. I advise you to read the policy of your cancellation insurance and the general terms and conditions of the travel organization carefully. If you have any questions about these documents, it may be useful to contact a lawyer or other legal expert. Please also note that some tour operators offer an option to offer a voucher or an alternative trip for the cancelled trip. This may allow you to make the trip at a later date.
