Municipality wants to attach street name sign to facade without permission?
Questioner
I have received a letter from the municipality stating that they intend to place a street name sign on my house. Based on art. 3:28 section 1 jo 2 Facilities for traffic and lighting of the Physical Living Environment Waterland 2021. However, I do not agree with this, mainly because it causes confusion. Our address is ..., we live in a corner house with an entrance with house number at the front of the house and a side entrance with house number (which we use as the main entrance). The street where our house is on the corner is called ... This is also the street name that the municipality wants to hang on our facade while we are .... This can cause a lot of confusion with the post, since our mail is delivered to the side of the house where our house number plate also hangs. This is the main reason why I am strongly opposed to this. We also had our facade completely renovated for thousands of euros and I do not want anything to be attached to it, because then I will have damage. I would very much like to know what to do in this matter.Lawyer
Art. 3:28 paragraph 1 jo 2 of the Traffic and Lighting Facilities of the Physical Environment Waterland 2021, on which the municipality bases its decision, probably concerns a local ordinance that gives them the right to make such adjustments, even on private property. However, you are not without rights in this case. If the attachment of a street sign would cause damage to your recently renovated facade, and/or if there is a risk of significant confusion as a result of the said placement, you could file an objection with your municipality. In this objection, you must explain why you believe the decision is inappropriate, substantiated with the relevant facts and circumstances. It may also be useful to suggest possible alternative solutions that would be less drastic for you. It is always wise to seek legal advice before taking a step like this, as the procedures and rules can be complex and confusing. A specialist lawyer or legal expert can help you draft your objection and advise you on your chances and possible strategies. It is therefore advisable to visit a legal advisor to discuss your situation further and draw up a plan of action.' ---------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
