Right to warranty for defective washing machine motor?
Questioner
We bought a washing machine on 29-03-2018. Now I have a mechanic come here nearby. He told us that the engine is broken. (He was also very surprised) My husband called the supplier and they said we had no warranty. I then sent another email and received no response. The mechanic (the same one) then ordered a new engine and installed it. He also said that this should not be possible with this type of washing machine. And certainly not in such a short period. I can't figure it out online myself. Can I ask you if I am still entitled to warranty? And how should I do this now?Lawyer
You are right to wonder whether you are entitled to a guarantee. The law sets good and clear rules that protect consumers. Based on consumer law in the Netherlands, you are entitled to a sound product. This means that the product must meet the expectations that you may have of it. If the product breaks down too quickly in this sense, you as a consumer are entitled to free repair or replacement, unless this is impossible or cannot be expected of the seller. That said, the warranty period that the store or manufacturer gives (often 1 or 2 years) is an additional service. This warranty does not change your rights. Even if the warranty period of the store or manufacturer has already expired, you are still legally entitled to free repair or replacement. In this particular case there are a few things to think about: 1. Did the engine break down during normal use? If the answer is yes, then it can be assumed that the product does not meet the expectations you may have of it and you may be entitled to repair or replacement. 2. If the product is outside the manufacturer's or seller's warranty, the law does require you to demonstrate that the product does not meet expectations. For this, you may be able to use the mechanic's report. Since this can be a complex and specific situation, I recommend that you seek the help of a lawyer or attorney to look at the specific circumstances and options together.
