Salary after company takeover?
Questioner
I work via an employment agency and my salary is the maximum of the relevant scale. What if I am now taken over via the company and they offer a lower salary during the employment conditions interview. Is that possible?Lawyer
In the event that a company is acquired, there are generally two possible scenarios regarding employment contracts. First scenario: your employment contract is taken over by the new company. This means that your salary, working hours, function and other conditions remain the same. Second scenario: the acquiring company wants to enter into a new employment contract with you. In this case, you are free to negotiate the terms of your new contract. If the new company offers a lower salary than your current maximum temporary employment salary, you will need to consider this and determine your position. Before agreeing to changes in employment conditions, it is wise to seek legal advice. For example, a specialist employment lawyer can help you assess and negotiate the conditions. Please note: it is not legally permitted for your new employer to unilaterally, without consultation and consent, change the employment conditions, unless this is explicitly provided for in your contract. Although negotiations are often possible, both you and the employer must agree on any changes to your employment contract. ------------ Stichting Rechtswinkel.nl is a national organization with students and volunteers.
