Employer not keeping agreements?
Questioner
Employer does not comply with agreements regarding placement in a position in a 5-shift schedule, then with false promises the employer buys time via an alternative place in the 4 shifts. After many agreements the employer continues to fail to comply with agreements and only further corners the employee with all kinds of agreements. Due to circumstances I ended up on sick leave and I am now being bothered with door-to-door visits by the employer himself and am forced to sign a VSO with only disadvantages because otherwise a file will be built up. The contract cannot be terminated prematurely and the employer has hindered possible redeployment to another better position elsewhere.Lawyer
If your employer does not comply with agreements as laid down in your employment contract, this can be seen as an unfair commercial practice. In most cases, it is not permitted to put someone under pressure to sign an agreement, especially if you are unable to assess the consequences of such an agreement due to illness or other circumstances. If your employer visits you at home without asking and you experience this as intimidating, this is also unacceptable. Based on the Medical Treatment Agreement Act (WGBO) and the General Data Protection Regulation (GDPR), you have the right to privacy, also in the context of illness. In your specific case, I would advise you to seek professional legal advice. You can contact an employment lawyer or, for example, the Legal Desk. It is also important to collect as much evidence as possible of the way in which your employer behaves, for example by writing down agreements, conversations and events, and if possible, documenting them with e-mails, letters or witness statements. Even if there is a settlement agreement (VSO) I would advise to have this checked by a lawyer or attorney. In some cases it may be the case that after signing such an agreement you have less or no right to unemployment benefits. Finally, the fact that your employer prevents you from finding another job may also be seen as unlawful, depending on the precise circumstances. It is therefore certainly important to discuss this with a professional who can advise you on the appropriate next steps. ---------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
