Cancel a purchase agreement signed in store?
Questioner
We concluded a purchase agreement on demand (bathroom) on January 2, after a conversation in the store. The salesperson said that we had to sign that day to still be able to use the December/end of year discount. But it turns out that the promotion was extended by the salesperson until mid-January, so we did not have to sign immediately. We were not told this. In addition, the agreement contains incomplete information about what we bought. For example, we bought a bathroom furniture, but the dimensions are not mentioned. How can we file a complaint afterwards if the agreed furniture is not delivered? Another point: we could not see some products in the store, but there was a photo of some products in the shop. Could we see this as “distance purchase”, because we actually bought from a catalogue?Lawyer
It sounds like there is a possible deception by the seller. Dutch law stipulates that an agreement is voidable if it was concluded under the influence of error and would not have been concluded if the facts had been correctly represented. Article 6:228 of the Dutch Civil Code regulates this. Such an error could, for example, be that the seller indicated that the discount would only apply that day, while this turned out not to be true. Regarding the missing information in the purchase agreement: It is important to have all agreements clearly on paper, such as the exact product description and the price. If this is missing, it can be difficult to exercise your rights in the event of problems. According to the law (art. 7:46c of the Civil Code), the consumer has the right to terminate the agreement within 14 days without giving reasons for a distance contract. However, this right usually only applies to transactions concluded entirely online, by telephone or by mail order, and usually not where you bought something in a shop, even if you were not able to physically see the product. However, this can vary from case to case and is also affected by specific facts and circumstances. --------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
