Contractor compensation for crooked wall
Questioner
I bought a house and upon completion in October 2022 it turned out that they had placed a wall crooked. Later it turned out that they had done this deliberately. I also reported this at the time, and wanted compensation. They came up with a compensation of 500 euros. Which of course is not realistic. If they had to change everything, it would have cost the contractor much more than 500 euros. I then spoke to a subcontractor who had to make the wall crooked by the contractor, and he informed me that it would cost at least around 5000 euros to adjust everything. I didn't want it to be adjusted after delivery because we had to move on, we no longer had a home and were temporarily sleeping in the cold garage. We had a schedule with all the workers, they couldn't just move everything around. Now I certainly don't want it to be changed, because then you'd have to tear everything out and I'd be covered in clutter from top to bottom and you'd just go from one thing to another. There is still an amount set aside with the notary, I said that it cannot be released yet because I want compensation first. Now the contractor says that if I don't release it I will have to pay interest. I said that I did not agree with this and that they should first resolve it in the form of compensation. Am I within my rights? I just want a fair compensation. A construction company can't just make a mistake on purpose that leaves me with crooked walls. How should I approach this?Lawyer
If the wall was deliberately made crooked, there must be a reason for this and that should have been discussed with you in advance. A crooked wall can of course cause the necessary problems. Also according to the requirements of the Building Decree. This issue will of course have to be resolved.
