Can my landlord ask me to leave my apartment if she decides to sell it?
Questioner
I have a contract with my landlord which says: 2 Duration, extension and termination 2.1 This rental agreement is entered into for a period of 1 year and will commence on 01-07-2023. 2.3 The Lessor will make the rented property available to the Tenant on the commencement date of the rental period as determined in Article 1, or if the Tenant has fulfilled all obligations towards the Lessor existing at that time. 2.4 If a fixed-term provision is included in 2.1 of this rental agreement and this period expires without notice, the rental agreement will continue for a maximum of 1 year until 30-06-2025. 2.5 Termination of the rental agreement by notice must be done by signed letter enclosed with an email addressed to Lessor. Notice period is 1 full calendar month. She is now telling me that she is selling the apartment, I want to know about my rights, am I entitled to stay until 30-06-2025 in the place, even if she sells the apartment?Lawyer
The landlord cannot unilaterally terminate the contract. The landlord will have to involve the court if you do not agree that the landlord is terminating the contract. As long as the judge has not decided that you must leave the house, the rental agreement will continue as normal. So, even if your landlord sells the apartment, you still have the right to stay in the apartment until 30-06-2025. The buyer will then be your new landlord.Take the next step
