Reclaiming legal costs: what to do?
Questioner
As the plaintiff, I am independently pursuing legal proceedings in the subdistrict court. The opposing party has included a counterclaim in its statement of defense. I am now considering hiring a lawyer. Will I be able to reclaim these costs (for an attorney) later? After all, I didn't name an attorney in the summons.Questioner
Dear questioner, If you do hire a lawyer, they can request an award of legal costs – if necessary, by filing a claim increase/amendment. Please note that legal costs are determined based on a scale, and actual costs incurred are not taken into account. Generally, you will be short of the award of legal costs. Yours sincerely,Questioner
A lawyer isn't necessary. However, it's important that the lawyer specializes in the relevant legal field. Incidentally, the award of legal costs generally doesn't cover costs.
