Objection letter SVB Payment AOW Assistance
Questioner
The SVB (Social Insurance Bank) made an error in awarding her AOW (state pension) benefits, and my mother, unknowingly, had her OW pension reduced starting in August 1998. This error was corrected in February 2013, and my mother received a back payment for the period from March 2007 to January 2013 (71 months). According to the SVB, it is not possible to go back further, referring to its own policy rules and 3:308 BW. This means my mother will miss out on the remaining 103 months, approximately €7,500. She's naturally happy with the lower amount she did receive, but it's still incredibly frustrating that, due to an organization's mistake, you don't get what you're actually entitled to. Does it make sense to object to the applied retroactivity?Questioner
Unfortunately, the SVB is formally right, but you could, of course, try to appeal and persuade the SVB to pay as a gesture of goodwill. If you'd like, I'd be happy to assist you.Questioner
Dear questioner, It's questionable whether the statute of limitations has started now that the SVB (Social Insurance Bank) and your mother only just learned of the error. Given the value of the claim, it wouldn't hurt to have a lawyer review it. Policy rules aren't decisive in this matter.Take the next step
