Liability for stolen items at school
Questioner
Hello, My MacBook was stolen from school a few months ago. The classroom was locked, but they somehow managed to get in. There was no break-in damage. I've now reported the theft, and the school's insurance company has taken the matter to court. Unfortunately, they won't pay anything. Is the school still liable, or something similar, if the classroom was locked? Hope someone knows.Questioner
What were the grounds for the school's insurance not paying out? And did the school admit liability? Why was the school's insurance company involved? I would argue that the school bears responsibility (safe classrooms, etc.) and can therefore be held liable for breaching its duty of care.Questioner
I was told the school wouldn't pay anything because students are always responsible for their own belongings. That was basically it. The school didn't admit liability but wanted to check if they were insured.Questioner
That's about it. Of course, you can take legal action in the subdistrict court (up to €25,000, legal representation is not mandatory). The dispute then concerns liability. Please also consult the school regulations.Take the next step
